1. Scope
These Terms and Conditions apply to all purchases made through the online shop operated at:

By placing an order, the customer confirms that they have read and accepted these Terms and Conditions.
Any mandatory rights granted to consumers under applicable law remain unaffected.
2. Artworks and Products
Lucien Désir offers contemporary artworks, including limited edition fine art prints produced on glass.
Unless otherwise stated on the relevant product page, the artworks are:
- produced as limited edition glass prints
- signed by the artist
- individually numbered
- limited to an edition of 99 copies
Each numbered print forms part of the stated edition. Edition numbers are normally allocated according to availability and cannot be selected unless this is expressly offered or agreed in writing.
Frames, mounting systems, display accessories or other elements shown in photographs are included only where expressly stated in the product description.
3. Artistic and Technical Variations
Product images are provided for illustrative purposes.
The appearance of an artwork may vary slightly from its representation on a computer, tablet or smartphone screen. Differences may result from:
- screen calibration and brightness
- colour reproduction
- ambient lighting
- reflections on the glass surface
- production and finishing processes
- the dimensions of the artwork
- the material and optical depth of the glass
Glass prints have a luminous and reflective physical presence that cannot be reproduced completely on a digital screen.
Minor variations in colour, brightness, contrast, surface, dimensions, positioning, finishing or appearance do not constitute a defect, provided that the artwork corresponds substantially to the description shown in the online shop.
The signature and edition number may be applied by hand. Minor variations in their appearance are inherent to the artistic and limited edition nature of the work.
4. Limited Editions
The stated edition size represents the maximum number of signed and numbered copies produced in the relevant edition.
Artist proofs, exhibition proofs or other proofs may exist separately from the numbered edition where this is stated or customary.
The purchase of a physical artwork does not transfer any copyright, reproduction right, image right or commercial exploitation right to the customer.
5. Conclusion of the Contract
The presentation of artworks and products in the online shop does not constitute a legally binding offer.
By completing the checkout process and submitting an order, the customer makes a binding offer to purchase the selected artwork or product.
After submitting the order, the customer receives an electronic acknowledgement of receipt. This automatic acknowledgement does not necessarily constitute acceptance of the order.
The contract is concluded when Filippo Salmina Design:
- sends an express order confirmation
- confirms dispatch
- begins production or preparation of the artwork
- or otherwise expressly accepts the order
Filippo Salmina Design may refuse or cancel an order if:
- the artwork is unavailable
- the edition is sold out
- payment is not authorised
- the information supplied by the customer is incomplete or incorrect
- delivery to the stated address is not possible
- an obvious pricing, technical or typographical error has occurred
- there is reasonable suspicion of fraud or misuse
If a paid order is not accepted, the amount already paid will be refunded using the original payment method.
6. Prices
All prices are stated in Swiss francs (CHF), unless another currency is expressly displayed.
Filippo Salmina Design is currently not registered for Swiss value added tax. Swiss VAT is therefore not charged or shown separately.
Shipping costs and any other charges collected by Filippo Salmina Design are displayed before the customer submits the order.
For deliveries outside Switzerland, the prices shown do not include foreign import VAT, customs duties, customs clearance charges, handling fees or other charges imposed by the destination country or by third parties.
Currency conversions displayed or processed by banks, card providers or payment service providers may be subject to their own exchange rates and fees.
7. Payment
Payment is due when the order is placed.
The available payment methods are displayed during checkout. Payment processing may be carried out by external payment service providers and may be subject to their technical and contractual conditions.
An order will normally be processed only after payment has been successfully authorised or received.
No additional surcharge is charged by Filippo Salmina Design for payment by credit card, debit card or another payment method displayed during checkout.
Any fees independently charged by the customer’s bank, card issuer or payment service provider are outside the control of Filippo Salmina Design.
8. Production and Availability
Some artworks may be produced, signed, numbered or prepared only after the order has been received.
Availability shown in the online shop is subject to confirmation. In exceptional cases, an artwork may become unavailable after an order has been submitted, particularly where the final available edition number has been sold through another sales channel.
If an ordered artwork is unavailable, the customer will be informed and any payment already received for that artwork will be refunded.
Production and preparation times may vary according to the artwork, format, glass printing process, signature, numbering, packaging and destination.
9. Cancellation of Orders
After an order has been submitted, the customer has no general contractual right to cancel it, except where a mandatory legal right of withdrawal applies.
Filippo Salmina Design may, at its own discretion, accept a cancellation request before production, signing, numbering, preparation or dispatch has begun.
There is no entitlement to cancellation once production or preparation of the ordered artwork has begun, except where mandatory consumer law provides otherwise.

10. Delivery Area
Orders may be delivered to addresses in Switzerland and in the member states of the European Union, subject to the delivery options available during checkout.
Delivery to other countries may be offered individually or through selected sales channels.
The customer is responsible for providing a complete and correct delivery address.
Any additional costs resulting from an incorrect or incomplete address, an unsuccessful delivery attempt, refusal of delivery or failure to collect a shipment may be charged to the customer where legally permitted.
11. Delivery Times
Estimated production and delivery times are stated on the product page, during checkout or in the order confirmation where available.
Delivery times are estimates and are not guaranteed unless a binding delivery date has been expressly agreed in writing.
Delivery may be delayed by:
- production requirements
- glass printing or finishing
- payment verification
- postal or carrier services
- customs procedures
- public holidays
- exceptional demand
- circumstances outside the reasonable control of Filippo Salmina Design
The customer will be informed if a significant delay becomes known.
Mandatory consumer rights relating to delayed delivery remain unaffected.
12. Shipping and Transfer of Risk
Artworks are packaged with particular care due to the fragile nature of glass prints.
Where mandatory consumer law does not provide otherwise, the risk of accidental loss or damage passes to the customer when the shipment is delivered to the customer or to a person designated by the customer.
For consumers in the European Union, the risk passes in accordance with the mandatory law applicable to the transaction.
If the customer independently commissions a carrier not offered by Filippo Salmina Design, the risk may pass when the artwork is handed over to that carrier, where legally permitted.
13. Customs Duties and Import Charges
For deliveries outside Switzerland, the customer is responsible for all:
- import VAT
- customs duties
- customs clearance charges
- carrier handling fees
- local taxes
- other charges imposed by the destination country or by third parties
These charges are not included in the product price or shipping costs unless expressly stated during checkout.
The customer is responsible for complying with the import regulations of the destination country.
Refusal to pay import charges, refusal of delivery or failure to collect a shipment does not automatically cancel the order.
If a shipment is returned for one of these reasons, Filippo Salmina Design may deduct the original shipping costs, return costs, customs charges, handling expenses and any loss in value from any refund, where legally permitted.
14. Inspection on Delivery and Transport Damage
The customer should inspect the external packaging and the artwork as soon as possible after delivery.
Visible damage to the packaging should, where possible, be noted with the carrier at the time of delivery.
Damage, breakage, cracks or other transport-related problems must be reported without undue delay to:

The report should include:
- the order number
- a description of the damage
- photographs of the outer packaging
- photographs of the internal packaging
- photographs of the damaged artwork
- photographs of the shipping label
The customer must retain the artwork and all original packaging until the claim has been assessed.
Failure to report damage immediately does not remove any mandatory statutory rights. However, delayed reporting may make it more difficult to establish that the damage occurred during transport.
The customer should not return a damaged glass print without first receiving return instructions.
15. Defective or Incorrect Artworks
If an artwork is defective, damaged or materially different from the ordered product, the customer must contact Filippo Salmina Design without undue delay.
Depending on the circumstances and the applicable law, Filippo Salmina Design may:
- repair the artwork
- replace it with another copy from the same edition, where available
- supply the correct artwork
- reduce the purchase price
- refund the purchase price
A replacement copy may carry a different edition number from the original damaged copy.
Normal reflections, slight colour variations, minor differences from screen images, handcrafted signature variations and other characteristics described in Section 3 are not considered defects.
Any mandatory statutory warranty and consumer rights remain unaffected.
16. No General Right of Withdrawal in Switzerland
Swiss law does not provide a general statutory right to withdraw from an online purchase merely because the customer has changed their mind.
Customers resident in Switzerland therefore have no general right to return an artwork without reason, unless Filippo Salmina Design expressly agrees to the return in writing.
This does not affect the customer’s rights in relation to defective, damaged or incorrectly delivered artworks.
17. Right of Withdrawal for EU Consumers
This section applies only to customers who:
- are consumers
- have their habitual residence in a member state of the European Union
- and are entitled to a mandatory right of withdrawal under the law applicable to the transaction
An EU consumer may withdraw from the purchase contract within 14 days without giving a reason.
The withdrawal period expires 14 days after the day on which the consumer, or a third party designated by the consumer other than the carrier, acquires physical possession of the artwork.
Where several artworks from one order are delivered separately, the withdrawal period begins when the final artwork is received.
To exercise the right of withdrawal, the consumer must inform Filippo Salmina Design of the decision to withdraw through an unequivocal statement sent to:

The consumer may use the model withdrawal form included at the end of these Terms and Conditions, but its use is not mandatory.
It is sufficient for the withdrawal notification to be sent before the withdrawal period expires.
18. Effects of Withdrawal for EU Consumers
When a valid withdrawal is exercised, Filippo Salmina Design will reimburse the payments received for the returned artwork, including the cost of the least expensive standard delivery method offered for the original order.
Additional delivery costs resulting from the consumer’s choice of a more expensive delivery method are not reimbursed.
The reimbursement will be made without undue delay and no later than 14 days after Filippo Salmina Design is informed of the withdrawal.
Filippo Salmina Design may withhold reimbursement until:
- the returned artwork has been received
- or the consumer provides evidence that the artwork has been returned
whichever occurs first.
The reimbursement will normally be made using the same payment method used for the original transaction, unless another method has been expressly agreed.
The consumer must return the artwork without undue delay and no later than 14 days after communicating the withdrawal.
Unless otherwise agreed in writing, the direct cost and risk of returning the artwork are borne by the consumer.
Because glass prints are fragile and may require specialist packaging, return shipping costs may be substantial.
The artwork must be returned with:
- its original protective packaging
- all supplied mounting or display components
- any certificate or accompanying documentation
- the signature and edition number intact
The consumer is responsible for any diminished value resulting from handling beyond what is necessary to establish the nature, characteristics and appearance of the artwork.
The consumer should not remove protective elements, install the artwork, alter it or display it in a manner that causes scratches, marks, breakage or other loss of value.
The customer must contact Filippo Salmina Design before returning the artwork in order to receive appropriate return and packaging instructions.
19. Exceptions to the EU Right of Withdrawal
The statutory right of withdrawal may be excluded where an artwork or product:
- has been made to the customer’s specifications
- has been clearly personalised
- has been produced in a special format requested by the customer
- contains a personalised dedication, inscription or configuration
- or falls within another statutory exception to the right of withdrawal
A standard signed and numbered copy from an advertised limited edition is not treated as personalised solely because it carries the artist’s signature and an edition number, unless the applicable law provides otherwise.
Where the right of withdrawal is excluded for a particular artwork, the customer will be informed before the order is placed whenever required by law.
This exclusion does not affect rights relating to defective, damaged or incorrectly delivered artworks.
20. Voluntary Returns
Customers who do not have a statutory right of withdrawal may request a voluntary return.
Filippo Salmina Design may accept or refuse such a request at its discretion.
A voluntary return is valid only if it has been expressly approved in writing before the artwork is sent back.
The customer may be responsible for:
- original shipping costs
- return shipping costs
- customs charges
- insurance
- payment processing costs that cannot be recovered
- diminished value
- specialist or replacement packaging
Unauthorised returns may be refused.
21. Return Packaging
Glass prints must be returned in packaging that provides protection equivalent to the original packaging.
The customer must follow any reasonable packaging and shipping instructions supplied by Filippo Salmina Design.
Returns should be sent using a trackable and appropriately insured shipping method.
Filippo Salmina Design is not responsible for loss or damage occurring during a return shipment arranged by the customer, except where mandatory law provides otherwise.
22. Retention of Title
The artwork remains the property of Filippo Salmina Design until the purchase price and all related amounts have been paid in full.
The customer may not resell, pledge, alter or otherwise dispose of an artwork before ownership has passed, where legally permitted.
23. Copyright and Intellectual Property
All artworks, images, photographs, drawings, texts, designs, videos, graphics, logos and other content displayed on lucien-desir.ch are protected by copyright and other intellectual property rights.
The purchase of an artwork transfers ownership only of the physical copy supplied to the customer.
It does not transfer:
- copyright
- reproduction rights
- publication rights
- distribution rights
- merchandising rights
- digital usage rights
- commercial licensing rights
The artwork may not be copied, scanned, photographed for commercial reproduction, distributed, modified, tokenised, used in advertising, incorporated into merchandise or otherwise commercially exploited without prior written permission.
The customer may display the physical artwork privately and may resell the original physical copy, subject to applicable law.
Images of the artwork may be used for a private resale listing only to the extent reasonably necessary to identify the physical artwork being resold.
24. Resale and Edition Integrity
The customer must not remove, conceal, alter or falsify the artist’s signature, edition number or accompanying documentation.
Filippo Salmina Design does not guarantee the future market value, resale value, investment performance or appreciation of any artwork.
Any statements concerning collectibility, rarity or exclusivity describe the artistic edition and do not constitute financial or investment advice.
25. Liability
Filippo Salmina Design is liable for direct damage caused intentionally or by gross negligence.
To the extent permitted by law, liability for slight negligence, indirect damage, consequential damage, loss of profit, loss of opportunity, loss of data and damage caused by third-party services is excluded.
Filippo Salmina Design is not liable for delays or non-performance caused by circumstances outside its reasonable control, including:
- transport disruption
- customs delays
- natural events
- strikes
- technical failures
- governmental measures
- shortages of materials
- failure of suppliers or service providers
Nothing in these Terms and Conditions excludes or restricts liability where such exclusion or restriction is prohibited by mandatory law.
26. Care and Installation
Glass artworks must be handled, transported, installed and displayed with appropriate care.
The customer is responsible for:
- using suitable wall fixings
- considering the weight and dimensions of the artwork
- ensuring that the wall or supporting structure is suitable
- following any mounting instructions supplied
- engaging a qualified installer where appropriate
- keeping the artwork away from conditions that may cause damage
Filippo Salmina Design is not responsible for damage caused by incorrect installation, unsuitable mounting materials, improper handling, impact, excessive heat, moisture, structural failure or use contrary to supplied instructions.
Mandatory liability rights remain unaffected.
27. Data Protection
Personal data is processed in accordance with the Privacy Policy published on lucien-desir.ch.
Data may be shared with payment providers, delivery companies, technical service providers and other parties where necessary to process and fulfil an order.
28. Amendments to These Terms
Filippo Salmina Design may update these Terms and Conditions when necessary.
The version in force at the time the order is submitted applies to the relevant purchase.
Material changes do not apply retroactively to contracts already concluded unless required by law or expressly agreed by both parties.
29. Severability
If any provision of these Terms and Conditions is found to be invalid, unlawful or unenforceable, the remaining provisions remain in effect.
The invalid provision will be replaced or interpreted as closely as legally possible to reflect its original commercial purpose.
30. Applicable Law and Jurisdiction
These Terms and Conditions and the contractual relationship between the customer and Filippo Salmina Design are governed by substantive Swiss law, excluding its conflict-of-law rules and the United Nations Convention on Contracts for the International Sale of Goods, to the extent legally permitted.
The courts at the registered place of business of Filippo Salmina Design have jurisdiction, to the extent legally permitted.
For consumers, this choice of law and jurisdiction does not deprive them of any mandatory protection or mandatory place of jurisdiction granted by the law applicable at their habitual residence.
